NOTIFICATION OF PRINCIPAL DESIGNER (FIRST APPOINTMENT) - In accordance with Regulation 16D of The Building (Approved Inspector) Regulations 2010 (as amended), where a Client appoints a Principal Designer (or Sole Designer), the Client must give notice of this to the Approved Inspector. This appointment must be made before the construction phase begins. Our standard form for giving this notice can be downloaded below.

NOTIFICATION OF PRINCIPAL CONTRACTOR (FIRST APPOINTMENT) - In accordance with Regulation 16D of The Building (Approved Inspector) Regulations 2010 (as amended), where a Client appoints a Principal Contractor (or Sole Contractor), the Client must give notice of this to the Approved Inspector. COMPLIANCE  DECLARATION - When work is complete, Regulation 16E of The Building (Approved Inspector) Regulations 2010 (as amended), requires the Client to give a "Compliance declaration" to the Approved Inspector. Our standard form for making this declaration can be downloaded below.  

REGULATION 38 (FIRE SAFETY INFORMATION)  DECLARATION - Building Regulations require the person carrying out the work to give fire safety information to the responsible person. C3 Design Approvals cannot issue a Final Certificate until we have received notification that this information has been provided. DEFINITIONS   

COMMENCED

 

We must be notified not more than five days after the date on which work is to be considered to have “commenced”. 

“Commenced” in this case has different meanings depending on the type of work as defined below:

 

Complex buildings

 

For complex buildings, work is to be regarded as commenced when the foundations supporting the building, and the structure of the lowest floor level of that building (but not the other buildings or structures to be supported by those foundations), are completed.

 

Complex buildings are:

 

  • to be constructed on the same foundation plinth or podium as any other building or structure;

 

  • a building which has more than one storey below ground level; or

 

  • a building where its proposed use is primarily as a public building[1] where the public, or a section of the public, has access to the building (whether or not on payment) provided that the building has a capacity for 100 or more visitors.

 

Buildings which are not complex buildings or horizontal extensions

 

Work is to be regarded as commenced when the sub-surface structure of the building, or the extension including all foundations, basement levels (if any) and the structure of ground floor level, is completed.

 

Work to existing buildings

 

Where the work consists of any other building work then work is to be regarded as commenced when the initial work is completed.

 

“Initial work” means the work set out in the initial notice which the client considers amounts to 15% of all the work described in the initial notice.

 

We will be required to provide a statement setting out the date when the work will reach the point it will be regarded as commenced within our Initial Notice submission to the local authority. We will ask you for this information on our appointment form.

 

[1] Public building means a shop or shopping centre; premises where food or drink are sold for consumption on the premises, including a nightclub, social club or dance hall; a stadium, theatre, cinema, concert hall; a sports ground; an exhibition hall or conference centre; a hospital or premises for the provision of health care.
